For example, you may wish to register to post entries or articles on the website, receive e-mails from us, receive invitations, attend events/workshops, preview new content, or to purchase goods and services available through the website. We need certain information from you to register you, authenticate you, and process your entries and payments, where necessary.

TERMS AND CONDITIONS

  • FEE AND TERM OF PAYMENT

The Client will pay the Consultant the fee and expenses set out in the Client Agreement. The fee and terms of payment shall be as stipulated as per the project built-up area. No deductions shall be made from the fee of the architect on account of penalty, liquidated damages, part rates or other sums.

The Consultant reserves the right to cease work in the case of breach of contract or the non-payment of fees.

  • CONDITION OF PAYMENT

All payments required to be made to us under this agreement shall be made within 7 days from the date of receipt of the bill.

  • COPYRIGHT

All documents prepared by Architect under this Agreement are the property and copy right of ASMARCH Private Limited and you shall not be entitled, either directly or indirectly to assign these documents or to make use of such documents for carrying out of any work beyond the works to which this Agreement relates, without the prior approval in writing by Architect.

  • ABANDONMENT

If Client abandons the whole or part of the work remaining to be carried out at any time, Architect shall be entitled to:

  • All payments which the client was required to make to the Architect under this agreement on or before the date on which such abandonment is known.
  • All payments in respect of any work done by Architect whether such work is complete or incomplete or whether it is done, executed, implemented or carried out at site or elsewhere, up to the date of abandonment.
  • ARBITRATION

Any and all disputes, disagreement and controversies arising in any manner which cannot be settled by mutual agreement between Architect and Client submitted to arbitration. 

Each party shall nominate one Arbitrator and the Two Arbitrators in turn shall nominate an Umpire.  In case the two Arbitrators do not agree on particular matter, the decision of the umpire shall be taken as final and binding on both the parties. All other provision of Arbitration and Conciliation Act 1996 with amendments shall apply and the venue of Arbitration shall be New Delhi.           

It is understood that during the period of our work Client will endeavor to provide to us any assistance as required, which will not involve any financial implications.

Any terms not laid down which may arise out of this agreement will be dealt  with in accordance with the conditions of engagement of Indian Institute of Architect and/or professional rules and  practices of Association of Consulting Engineers, India.

 

REFUND AND CANCELLATION POLICY:

  • CLIENT REFUNDS

‍Project Cancellation: If you cancel a project before any work has begun, you are entitled to a full refund of any payments made to Asmarch.

Work Dissatisfaction: If you are unsatisfied with the completed work, you can request a refund within 7 days of delivery. Our team will review the project details, and if the delivered work does not match the agreed-upon requirements, a partial or full refund may be issued.

Platform Fee Refunds: Asmarch platform fees are non-refundable once a project has commenced.

  • ARCHITECT REFUNDS

Project Cancellation: If a client cancels a project before any work has begun, any pending payments will not be made due to non-active state of the project.

Payment Disputes: In case of a payment dispute with a client, Asmarch will investigate and release payment if deemed appropriate.

  • REFUND FOR EVENTS/WORKSHOPS

There shall not be any refund for events/workshops once registered. Although if one miss to attend any purchased event/workshop we allow to attend similar workshop in replacement, subject to commencement.

  • REFUND PROCESS

    1. To request a refund, please submit a request through our support portal or by emailing asmarchpvtltd@gmail.com.

    2. Our team will review your request within 7 business days and may request additional information or documentation.

    3. If approved, refunds will be processed within 10 business days and credited back to the original payment method.

    Please note that refunds may be subject to additional terms and conditions based on the specific circumstances of your project or subscription plan. Asmarch reserves the right to refuse refunds in cases of abuse or violations of our policies.
